1. Agreement to Terms
Welcome to The Arabic Poetry ("Platform," "we," "us," or "our"). By accessing or using our platform, whether as a registered user or visitor, you agree to comply with and be bound by these Terms of Service ("Terms").
These Terms constitute a legally binding agreement between you and The Arabic Poetry. If you do not agree to these Terms, you must not access or use the Platform.
By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. Your continued use of the Platform following any changes to these Terms constitutes acceptance of those changes.

3. Platform Access
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.
3.1 Restrictions
You may not:
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without our express written permission.
- Use automated means (bots, scrapers, crawlers) to access the Platform without authorization.
- Attempt to circumvent any security features or access restrictions.
- Interfere with or disrupt the Platform's operation or servers.
- Use the Platform for any illegal or unauthorized purpose.
3.2 Platform Availability
We do not guarantee that the Platform will be available at all times or error-free. We may modify, suspend, or discontinue the Platform at any time without notice or liability.
4. User Accounts
Some features of the Platform require you to create an account. When creating an account, you must provide accurate, complete, and current information.
4.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account.

5. Content Ownership and Licensing
5.1 Platform Content Ownership
All Platform Content, including but not limited to text, graphics, logos, audio files, software, and design elements, is owned by or licensed to The Arabic Poetry and is protected by copyright, trademark, and other intellectual property laws.
5.2 License to Use Platform Content
We grant you a limited license to access and use Platform Content for personal, non-commercial purposes. You may not:
- Modify, copy, distribute, or create derivative works from Platform Content.
- Remove copyright notices or other proprietary markings.
- Use Platform Content for commercial purposes without written permission.
5.3 Citation and Academic Use
You may cite or quote poetry and translations from the Platform for academic or educational purposes, provided you provide proper attribution and comply with fair use principles.
6. User-Submitted Content
6.1 Ownership of User Content
Important: You retain all ownership rights to the content you submit to the Platform. The Arabic Poetry does not claim ownership of your poems, audio recordings, or other submissions. You are solely responsible for the content you submit.
6.2 License Grant
By submitting User Content to the Platform, you grant The Arabic Poetry a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to:
- Display, distribute, and make your User Content available on the Platform.
- Use your User Content for promotional purposes, including on social media, newsletters, and marketing materials.
- Modify or adapt your User Content for technical or formatting purposes (without altering the substantive content).
- Create thumbnails, previews, or excerpts of your User Content.
This license allows us to operate the Platform and promote content, but does not transfer ownership to us. You may request removal of your content at any time (subject to technical limitations).
6.3 Your Representations and Warranties
By submitting User Content, you represent and warrant that:
- You own all rights to the content or have obtained all necessary permissions.
- Your content does not infringe on any third-party intellectual property rights.
- Your content does not violate any laws or these Terms.
- You have obtained all necessary rights to any audio recordings you submit.
6.4 Responsibility for User Content
Platform Disclaimer: The Arabic Poetry is a platform for sharing user-generated poetry and audio content. We do not create, endorse, or take responsibility for User Content. Any views, opinions, or statements expressed in User Content are those of the individual users, not of The Arabic Poetry.
We are not liable for any User Content that may be offensive, inaccurate, inappropriate, or illegal. Users are solely responsible for their submissions.
6.5 Content Moderation
We reserve the right, but are not obligated, to:
- Review, monitor, or remove User Content at our discretion.
- Refuse to publish or remove content that violates these Terms.
- Remove content in response to copyright claims or legal requests.
- Take action against users who repeatedly violate our policies.
However, we do not pre-screen all User Content and are not responsible for monitoring all submissions.
6.6 Copyright Infringement
If you believe content on the Platform infringes your copyright, please contact us at info@thearabicpoetry.com with:
- Identification of the copyrighted work.
- Location of the infringing content on the Platform.
- Your contact information.
- A statement that you believe in good faith that the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
7. Prohibited Uses
You agree not to use the Platform to:
- Upload or transmit viruses, malware, or other harmful code.
- Harass, abuse, threaten, or intimidate other users.
- Post content that is defamatory, obscene, pornographic, hateful, or discriminatory.
- Violate any laws or regulations.
- Infringe on intellectual property rights of others.
- Impersonate any person or entity.
- Collect or harvest personal information from other users.
- Engage in spam, phishing, or fraudulent activities.
- Attempt to gain unauthorized access to the Platform or other users' accounts.
- Use the Platform for commercial purposes without permission.
Violation of these prohibitions may result in immediate termination of your account and may be reported to appropriate authorities.
8. Disclaimers and Limitation of Liability
8.1 "As Is" Basis
THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8.2 No Responsibility for User Content
We disclaim all liability for User Content. The Arabic Poetry does not verify, endorse, or take responsibility for any User Content. We are not liable for any harm, loss, or damage resulting from User Content, including but not limited to:
- Inaccurate, offensive, or inappropriate content.
- Copyright infringement or intellectual property violations by users.
- Defamatory, harmful, or illegal content posted by users.
Users who post content are solely responsible for ensuring their content complies with all applicable laws and does not infringe on third-party rights.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ARABIC POETRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Platform.
- Any User Content or conduct of any third party on the Platform.
- Unauthorized access to or alteration of your content or data.
- Any interruption or cessation of the Platform.
OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.
8.4 Third-Party Links
The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites.
9. Indemnification
You agree to indemnify, defend, and hold harmless The Arabic Poetry, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Platform.
- Your violation of these Terms.
- Your User Content, including any intellectual property infringement or other legal violations.
- Your violation of any rights of another party.
This indemnification obligation means that if someone sues us because of something you posted or did on the Platform, you are responsible for defending and covering any costs associated with that lawsuit.
10. Termination
10.1 Termination by You
You may terminate your account at any time by contacting us or using account deletion features. Upon termination, your account will be deactivated, but your User Content may remain on the Platform unless you request its removal.
10.2 Termination by Us
We may suspend or terminate your access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.
10.3 Effect of Termination
Upon termination:
- Your right to use the Platform will immediately cease.
- We may delete your account and User Content (subject to technical limitations and legal requirements).
- Provisions of these Terms that by their nature should survive termination shall survive, including ownership, disclaimers, indemnification, and limitations of liability.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:
- Posting the updated Terms on the Platform with a new "Last Updated" date.
- Sending an email notification to registered users (when feasible).
Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Platform.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
12.2 Dispute Resolution
If you have a dispute with us, you agree to first contact us at info@thearabicpoetry.com and attempt to resolve the dispute informally.
If a dispute cannot be resolved informally, you agree that any legal action or proceeding shall be brought exclusively in the courts located in the United States, and you consent to the jurisdiction of those courts.
12.3 Class Action Waiver
You agree that any disputes shall be resolved on an individual basis. You waive any right to bring claims as a class action, collective action, or representative action.
